Terms of Service

These Terms of Service ("Terms") are an agreement between you and Mikalsen AI AS (organisation number 932 254 026), the company that operates Unfair Racing ("Unfair Racing", "we", "us"). They govern your use of the Unfair Racing desktop app, the mobile companion apps for iOS and Android, and this website.

By installing, accessing, or using Unfair Racing, you agree to these Terms. If you do not agree, do not use the apps. Nothing in these Terms limits your mandatory rights as a consumer under Norwegian or EEA law.

Acceptance and eligibility

You must be an adult, or otherwise have the legal capacity to enter into a contract, to create an account. By creating an account you confirm that the information you provide is accurate and that you are authorised to accept these Terms.

If you set up a profile for a young driver, you confirm that you are their parent, guardian, or an authorised coach, and that you consent to the processing of that driver's data as described in our Privacy Policy.

The service

Unfair Racing is a coaching and analysis tool for karting and motorsport. It helps you plan changes, record setups and telemetry, and review your sessions across desktop and mobile.

Unfair Racing is a tool, not a substitute for a human coach, engine builder, or chassis specialist, and it does not guarantee any particular result. We do not warrant that following its recommendations will produce faster lap times or better results. You remain responsible for your own decisions and your vehicle.

Your account

You are responsible for your account and for keeping your sign-in credentials secure. You agree to:

  • Provide accurate account information and keep it up to date.
  • Keep your password or sign-in link confidential and not share your account.
  • Tell us promptly at support@unfair.racing if you suspect unauthorised use of your account.
  • Be responsible for activity that happens under your account.

Subscriptions, trials, and billing

Unfair Racing offers a free tier and paid Pro and Team subscriptions. New users can start a 14-day Pro trial. If you do not subscribe, your account moves to the free tier when the trial ends.

Paid subscriptions purchased through the desktop app are billed through our payment processor (Stripe) and renew automatically — monthly or annually, depending on the plan you choose — until you cancel. Prices are shown before you buy and may change with notice for future billing periods.

  • The mobile companion apps are free to download and require an existing Unfair Racing account; they do not, by themselves, sell subscriptions.
  • If we ever offer subscriptions for purchase inside the iOS or Android apps, those purchases are processed and managed by Apple or Google under their terms, including their billing and renewal rules.
  • To manage or cancel a subscription bought through an app store, use that store's subscription settings.

You are responsible for any taxes that apply to your purchase, except taxes on our income.

Cancellation and refunds

You can cancel a subscription at any time from inside the app, by emailing support@unfair.racing, or — for app-store purchases — through the app store. Cancellation takes effect at the end of the current billing period, and you keep access until then.

If you are a consumer in the EEA, you have a statutory right to withdraw from a purchase within 14 days, subject to the rules on digital services you have started to use. Refunds for purchases made through an app store are handled by Apple or Google under their refund policies. Outside these rights, refunds for unused service are at our reasonable discretion.

Acceptable use

When you use Unfair Racing, you agree not to:

  • Break the law or infringe anyone else's rights.
  • Reverse-engineer, decompile, or attempt to extract source code, except where the law expressly allows it.
  • Circumvent trial limits, licensing, or our anti-abuse measures, including by trying to claim multiple free trials.
  • Share, resell, or sublicense your account beyond the seats included in your plan.
  • Interfere with, overload, or disrupt the service or its security.
  • Upload content you do not have the right to use, or that is unlawful.

Your content and data

You keep ownership of the data and content you create in Unfair Racing — your setups, telemetry, notes, and observations. You grant us only the limited licence we need to host, process, sync, and display that content in order to provide the service to you.

Optional, anonymised data pools are strictly opt-in. If you choose to contribute, you grant us a licence to use the anonymised, aggregated signals to improve the product, as described in our Privacy Policy.

Race-day use and safety

You are responsible for using Unfair Racing safely and in line with the rules of the relevant motorsport body and event. Do not operate the app in a way that distracts you while driving.

Unfair Racing does not provide live in-cockpit audio coaching; it is designed to respect the regulations of motorsport bodies, including NBF §715.19 and equivalent rules. You are responsible for compliance at your events.

Intellectual property

Unfair Racing, including its software, design, and content (other than your own data), is owned by Mikalsen AI AS and protected by intellectual-property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the apps for their intended purpose while your account is in good standing. All rights not expressly granted are reserved.

Apps from the App Store and Google Play

If you download a mobile app from Apple's App Store or Google Play, the following also applies:

  • Your use of the app must comply with the app store's usage terms — the Apple Media Services Terms and Conditions, or the Google Play Terms of Service.
  • These Terms are between you and us, not with Apple or Google; Apple and Google are not responsible for the app or its support.
  • For iOS, where no separate end-user licence agreement is provided, the app is licensed under Apple's standard Licensed Application End User License Agreement.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms for the iOS app and may enforce them against you.

Disclaimers

Unfair Racing is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or that it will meet your specific expectations. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.

Limitation of liability

To the maximum extent permitted by law, our total liability to you under these Terms is limited to the subscription fees you paid to us in the twelve months before the event giving rise to the claim. We are not liable for indirect, incidental, or consequential losses, or for lost results, lost data you could have backed up, or loss of profit.

Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for gross negligence or intentional misconduct, or your mandatory rights as a consumer.

Suspension and termination

You can stop using Unfair Racing and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, misuse the service, or where we are required to by law.

When your account ends, your right to use the apps stops. You can request deletion of your data as described in our Privacy Policy.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app or by email. If you keep using Unfair Racing after a change takes effect, you accept the updated Terms.

Governing law and disputes

These Terms are governed by the laws of Norway, without regard to conflict-of-law rules. Disputes will be subject to the ordinary courts of Norway, with Oslo as the legal venue, unless mandatory consumer law gives you the right to bring a claim where you live.

If you are a consumer, you may also use the relevant dispute-resolution and complaint bodies available to you, including the EU Online Dispute Resolution platform.
